    There is no such thing as a -medical spa- in Florida. True! They are not uniquely licensed. In fact, they are usually not licensed at all because (1) they are owned and operated by licensed healthcare professionals, and/or (2) they do not file claims for reimbursement with health insurers. And they are not a regulated entity.

    What then is a -medical spa-? It’s simply a place where people receive traditional spa services (e.g. facials), plus many other medical procedures, typically focused on cosmetic services (e.g. hair removal, Botox). It’s -medical- because of the nature of the services provided. It’s -medical- because (ideally) physician supervision is woven into the business model.

    The trickiest part of medical spas for owners/operators is ensuring just two things: (1) that the professionals providing the services are doing so in a manner that doesn’t violate their licenses, and (2) those professionals have proper physician supervision. Each licensed person who typically works in a med spa is bound by statutes and regulations that govern what they can do and the degree (if any) of physician supervision required. The -scope of practice- regs applicable to PAs are different that those which apply to NPs or MAs for instance. The level of physician supervision is dictated not only by the license of the supervised professional, but also what the professional is doing. Rest assured, however, that the belief that such -formal- things do not apply because the patients pay in cash is not only untrue, but also a recipe for being shut down and prosecuted.

    Other big challenges for med spas tend to be-

    ?Fee splitting arising in connection with how the professionals are paid (especially when they are paid on a percentage of collections basis)

    ?The Florida Patient Self Referral Act, which in part may limit to 50% the amount of physician ownership if the physician is in a position to refer to the med spa.

    Regulatory scrutiny can be expected to increase in coming years, especially as the media shines light on client injuries (typically burns from laser services) and the scope of services expands to include things like hormone replacement therapy (HRT), which traditionally involves telemedicine related issues. Med spa owners would do well to take seriously the many intricate (and disconnected) regs applicable to the licensed professionals who work in med spas and the physicians who supervise them.

    Osteogenesis imperfecta are big words, especially for a 6-year-old. But the words are a medical term that Leigh Dittman is not only able to easily say; she knows exactly what it means.

    Leigh was registered as a patient at Shriners Hospitals for Children-Tampa before she was even born. Her parents realized their baby would need orthopaedic care when technicians noticed Leigh’s legs were shorter than normal during one of Ellen Dittman’s sonograms. Doctors were unable to diagnose the problem before Leigh’s birth but knew it was orthopaedic-related. Ellen and her husband, David, contacted the Tampa Shriners Hospital.

    When Leigh was born, she measured only 15.5 inches long, and doctors discovered she had broken five ribs and fractured a femur in utero. A few hours after her birth, Leigh was diagnosed with osteogenesis imperfecta (OI), a genetic disorder caused by imperfectly formed bone collagen. The condition is commonly known as “brittle bone disease” and is characterized by bones that break easily, often from little or no apparent cause.

    First Treatment At 3 Weeks Old

    Leigh received her first treatment at the Tampa Shriners Hospital when she was three weeks old. She now goes in every few months to receive intravenous medicine meant to increase bone density, but Leigh usually stops by the hospital at least once a month to visit her doctors and the many friends she’s made there. “We love it,” said Ellen. “That hospital is like our second home.”

    In appreciation of the loving care Leigh receives at the Tampa hospital, the Dittman family began raising money for Shriners Hospitals. “It was actually Leigh’s idea,” said Ellen. “She says Shriners helps her, so she wanted to help them.”

    An Overwhelming Response

    Beginning with Leigh’s fourth birthday party in 2004, the Dittmans asked that, in lieu of bringing gifts, guests donate money to Shriners Hospitals. Due to the overwhelming response from loved ones and the community, Leigh and her family decided to make it an annual fundraising event.

    Approximately 450 people attended Leigh’s sixth birthday party in August. The event, which included dinner, a special video about the Tampa Shriners Hospital, a chance drawing, a silent auction and dancing, raised more than $50,000. In total, Leigh’s birthday party extravaganzas have resulted in nearly $78,000 in donations to the Tampa Shriners Hospital.

    Leigh and her father, David, accept a donation to the Leigh Dittman Foundation. Leigh’s third-annual fundraising event raised more than $50,000 for the Tampa Shriners Hospital.

    Time synchronization goes farther than that. All network clocks work off standard internet time signals so they all read the same time, adjusted for time zone. This means all branches of a hospital system are on the same time. Shift changes occur at the right time, ensuring patients are not left without qualified medical staff on duty, and that no ward is double-staffed.

    Reduced Liability

    Malpractice is a serious concern in the healthcare industry, and often malpractice suits stem from simple mistakes. Hospital clocks reduce errors by keeping everyone on the same schedule. Medication is administered when needed. Nurses making notes on charts record the time precisely. Doctors start rounds on time. Everyone gets to the operating room at the right moment.

No dangerous power lines need to be run to the clocks, so they can be installed by the hospital’s own IT staff.

    This flexibility makes it easy to mount them wherever they are needed. No longer is the clock placed near an outlet, even if that location makes the timepiece hard to read. Hospital clocks can be mounted anywhere in a matter of minutes.

    Synchronized clocks provide savings immediately as they improve hospital operational efficiency, raise patient care quality and reduce power consumption.     The U.S. House of Representatives recently passed HR3962: the Affordable Health Care for America Act of 2009. The legislation is thousands of pages long, making it difficult for regular taxpayers to understand how the bill will affect them.

    Tax Penalties

    The new legislation is very expensive, and Congress has come up with a number of ways to pay for it. First of all, there will be a shared responsibility provision that basically forces taxpayers who cannot establish acceptable health care coverage to pay an additional 2.5% tax. There will be a hardship exception though, for taxpayers who cannot afford to pay the tax.

    Payroll Penalty

    In addition to a penalty on taxpayers who cannot afford coverage, the government will also assess an 8% payroll tax on businesses that do not offer health insurance to their employees. However, it is widely expected that the penalty will be reduced to 5% when the Senate revises the bill.

    Millionaire Surtax

    One of the largest sources of funding for the reform bill is a new surtax on individuals making more than $500,000 per year, of couples making over $1 million. In the House’s bill, beginning in 2010 all taxpayers making a qualifying amount will be subject to a massive 5.4% tax increase.

    Inflation Increases

    In addition to adding heft tax increases, the bill also partially repeals tax indexing for inflation. This will result in more money for the Federal government as the years go by. According to the Joint Tax Committee the surcharge is only expected to generate $30.9 billion in 2011, but nearly $70 billion in 2019.

    Passage into Law?

    The present version of this bill is not likely to get passed into law. Despite President Obama’s optimistic stance, some Senators are already pronouncing the bill dead on arrival. Although there has been a lot of discussion about this health care reform bill, it could be months before even a highly amended version of it becomes law. The Senate is not going to vote on the bill until at least 2010, and since they are expected to make numerous modifications it will likely need to return to the House for another vote. It could be six months from now before a health care bill goes to President Obama’s desk for a signature.
